US Citizenship and Immigration Services (USCIS) said on Wednesday that applicants who were refused or administratively closed for an H-1B visa in FY21 may resubmit their applications if their desired start date is after October 1, 2020.
The number of petitions submitted during the first filing period for fiscal 2021 was below the estimated numbers required to meet the numerical allocations. The disparity was attributed to the Covid emergency. FY21 was also the first year for computerized registration.
“If your FY21 petition was refused or administratively closed only because you sought a start date after October 1, 2020, you may re-submit that previously filed petition, with all appropriate fees,” USCIS added.
